Planning Department

The Planning Department is responsible for administering and amending the Master Plan for the physical development of our municipality. All requests for resubdivisions, zoning changes, zoning appeals and Planned Unit Developments are processed through the Planning Department. The Planning Department, along with the Planning and Zoning Commission, makes recommendations on the City's Capital Budget and Program. Furthermore, Planning maintains city maps and land records, assembles and provides demographic and economic data, and provides graphic services to the City.

The Planning Department works in conjunction with three Boards toward improving the quality of life in our community; the Planning and Zoning Commission, the Board of Zoning Adjustments, Historic District Commission. and the Tree Board. The necessary paperwork required by these Boards may be obtained through the Planning Department at 1801 Williams Boulevard, Building C, Room 400 or may be downloaded by following the hyperlinks below. It is highly recommended that any proposal be discussed with the Planning Department staff prior to application submittal.

Planning and Zoning Commission

The Planning and Zoning Commission has a seven member board that is regulated by Applicable State Law. The Commission's actions, approved or disapproved, on any matter are forwarded as recommendations to the City Council. Prior to any zoning modification or resubdivision proposals being sent to the Council, this Commission will hold a public hearing to determine if these requests are within State and City guidelines and the criteria for sound planning. The legislation is voted on at the meeting and forwarded to the City Council for final approval or denial.

These meetings are held in the Council Chambers on the fourth Wednesday of every month unless otherwise advertised in our Official Journal, the Times Picayune.

Board of Zoning Adjustments

This board consists of five members and two alternates who are responsible for hearing appeals based on permit denials by the Inspection & Code Enforcement Department. This board has the power to grant certain exceptions and variances from standard zoning regulations where unusual or impractical circumstances are demonstrated, provided the general welfare of the community is not affected. A hardship on the citizen involved is the main basis for approval.

Some typical requests for which a variance may be granted could relate to a rear, front or side yard setback, the placement of a fence or the location in which an air conditioner can be installed.

Historic District Commission

This Commission consists of six voting members, as well as a non-voting architectural advisor. In the event of a tie vote, the Councilperson for District 1 will be the deciding factor in the case. The Historical District Commission is responsible for the Historic District area and also for "RT-R1-PO" and RT-C1-PO" zoning classifications. The district is bounded by the Mississippi River, Kenner Avenue, Compromise Street and Daniel Street.

The goal of the Historical District Commission is to preserve and protect historic structures and neighborhoods. Furthermore, they work toward improving property values in and around the area designated as the Historic District in South Kenner.

The Commission has the authority to approve, deny or approve with stipulations any exterior structural changes occurring within the District. A representative from the Planning Department coordinates with Commission members and the applicant to ensure that all requirements are met. Upon approval by the Historical District Commission, the property owner is free to obtain any necessary permits for any permitted uses through the Inspection & Code Enforcement Department and to proceed in accordance with the plans presented to the Commission. If such a request has been denied, the applicant may file an appeal to the City Council through the Inspection & Code Enforcement Department. Requests involving certain other uses must be forwarded under the Planned Unit Development process to the Planning Commission for their recommendation and then to the Council for final approval.

This Commission meets on an as needed basis in the Planning Department at the discretion of the Commission Chairman.

PROCEDURE FOR REZONING


  1. Submit to the Director of Planning the following:

    1. Letter of transmittal.

    2. Original ordinance.

    3. Original survey (16 copies if larger than 11 x 17)

    4. Petition stating the rezoning request, signed by 51% of the property owners of the property involved.

    5. Check payable to the City of Kenner - $200.00 first acre, $50.00 per additional acre up to $5000.00 maximum. RI-P $100.00 all cases.

    6. Notarized list of adjoining property owners certifying it to be true and correct. This list should include the owner's name, address, subdivision name, square and lot numbers of all property within two hundred fifty feet (250') radius of the property proposed for rezoning.

  2. No case will be processed unless all of the above items are presented to this office prior to advertisement.

  3. Request will then be advertised for three (3) consecutive weeks in the Official Journal stating the purpose, date, time and place of the public hearing of the Planning and Zoning Commission.

  4. Petitioner will then be notified as to the date, time and place of the public hearing. Petitioner is requested to appear at the public hearing to present the case.

  5. After approval or disapproval by the Planning and Zoning Commission, the case shall be forwarded to the City Council to be placed on the agenda for the next City Council meeting for action. The Council Office will also advertise the request.

PROCEDURE FOR PLANNED UNIT DEVELOPMENT


Submit to the Planning Department the following:

  1. Letter of transmittal.

  2. Original ordinance typed single space on legal size paper.

  3. Original of survey (with signature block). If survey is larger than 11 x 17 we will need 10 copies.

  4. Original site plan showing building location, with dimensions to all property lines, also showing required offstreet parking and loading spaces and all appropriate drives and apron strips. (Put signature block on original). If larger than 11 x 17 we will need 10 copies.

  5. Original landscape plan and sign plan (with signature block). If larger than 11 x 17 we will need 10 copies.

  6. In addition to your original plans, we will need a reduced 11 x 17 copy of plans.

  7. If property abuts canal, submit written approval of site plan from Jefferson Parish Department of Public Utilities regarding canal servitude's, water and drainage.

  8. Statement of ownership of property.

  9. Cost for Planned Unit Development: $300 for the first two acres, $125 per acre thereafter up to $5000 maximum, $100 for all R1-P and C1-PO cases. If a resubdivision is included there is an additional charge of $10 per property assessment for research by the City of Kenner Finance Department, to determine whether or not there are any City liens against proposed resubdivision of property. Make check payable to the "City of Kenner ".

PROCEDURE FOR RESUBDIVISION

NOT CREATING AND DEDICATING NEW STREETS

Submit to the Planning Department the following:

  1. Letter of transmittal.

  2. Original ordinance typed single space on legal size paper.

  3. Original resubdivision survey with signature block. If survey is larger than 8 1/2 x 14, please provide us with 11 copies and one copy reduced to no larger than 11 x 17. All existing building and other improvements must be shown on survey.

  4. If property abuts a canal, submit written approval of site plan from Jefferson Parish Department of Public Utilities regarding canal servitude's, water and drainage.

  5. Statement of ownership of property, signed by property owner(s).

  6. Any property abutting more than one street right-of-way must define the present conditions of the property and the street right-of-way and the developer must state his intentions to develop the property in the ordinance. NOTE: The Planning Commission has the power to recommend the streets be improved.

  7. No lot shall be less than 50 feet in width or less than 100 feet in depth as per Ordinance No. 2427 and the City of Kenner Subdivision Code, Section 14.9, Item C. See minimum lot requirements per zoning district.

  8. Cost for resubdivision: $100 for the first two acres and $50 per acre thereafter up to a maximum of $5000. There is an additional charge of $10 per property assessment for research by the City of Kenner Finance Department, to determine whether or not there are any City liens against proposed resubdivision property. Make check payable to the "City of Kenner".

  9. A City Finance Department's certificate of clearance indicating that all liens or taxes against the property proposed for subdivision has been satisfied. The Planning Department will obtain this certificate.

NO CASE WILL BE ACCEPTED UNTIL ALL THE ABOVE ITEMS ARE RECEIVED BY THIS DEPARTMENT TEN (10) WORKING DAYS PRIOR TO THE PLANNING COMMISSION MEETING. PROCEDURE FOR SUBDIVISION CREATING AND DEDICATING NEW STREETS

In addition to the foregoing a subdivider who creates and dedicates new streets must submit the following:

  1. A preliminary plan of subdivision as required by the subdivision regulations, for approval by the Planning Commission, such plan to be accompanied by preliminary approval routing sheet circulated by Planning Department with any comments from appropriate City departments and letters from appropriate Parish departments and private utilities. (Any City departments' comments will result from Subdivision Review Committee meeting, to which subdivider or his representative will be invited, and which will be held upon submission of the tentative plan).

  2. A completed ownership form (see #5 in foregoing procedure) authorizing the engineer or other agent to act on his behalf.

  3. Engineering plans prepared by a licensed and registered engineer together with the above ownership form shall be submitted by the engineer or agent to the following departments:

    Kenner Department of Public Works.
    Kenner Department of Wastewater Operations.
    Kenner Department of Code Enforcement (Street Lighting).
    Kenner Fire Department.
    Jefferson Parish Department of Water.
    Jefferson Parish Department of Public Utilities.

    Upon notification of submission by subdivider, Planning Department will send Engineering Plans routing sheet accompanied by ownership form to above City departments.

  4. A final plan of subdivision for Planning Commission approval, as required by the subdivision regulations along with the completed Engineering Plans routing sheet. Prior to City Council approval of the final subdivision plan, a copy of the signed, approved and dated cover sheet of the engineering plans for each City and Parish department must be submitted to the Planning Department for its file and records.

  5. A bond or contract, in favor of the City, to cover the off-site improvement costs, as approved by the City Engineer(s), must be submitted to the Planning Department within 30 days of the Council adoption date of the subdivision ordinance; otherwise, subdivision ordinance, predicated on such bond or contract, along with accompanying final plan becomes void (Section 14-14(e) of the Subdivision Regulations).

  6. Engineer or agent requests pre-construction meeting with the Kenner Departments of Public Works (at Public Works), Wastewater and Code Enforcement to establish construction and inspection fees and to a receive notice to proceed.

Submit to the Planning Department the following:

  1. Cover letter.

  2. Original resubdivision survey. If survey is larger than 11 x 17, please provide this department with a reduction no larger than 11 x 17.

  3. Statement of ownership of property, signed by property owner(s).

  4. Cost for resubdivision is $100.00. If payment is made by check, make check payable to the "City of Kenner".

There is an additional charge of $10.00 per property assessment for research by the City of Kenner Finance Department; to determine whether or not there are any City liens against proposed resubdivision property. (Do not pay this research fee at the submittal of the resubdivision, we will call and inform you of the amount, after it is submitted to the Finance Department).

PROCEDURE FOR BOARD OF APPEALS


After notification by the Director of the Department of Inspection & Code Enforcement that a building permit has been denied, the following items must be submitted in the event the applicant wishes to appeal the decision of the Director:

  1. A letter of appeal addressed to the Board of Zoning Adjustments, 1801 Williams Boulevard, Kenner, Louisiana 70062. In stating your appeal, give the municipal address where variance is requested.

  2. Permit Plot Plan Form (stamped "disapproved" listing all reasons of denial) filled out showing location of the building and offstreet parking spaces, etc., as required.

  3. One copy of a Survey is required.

  4. One copy of any and all drawings necessary for presentation of the case.

  5. Fees payable to the City of Kenner to handle advertisement and expenses for the case are as follows:

    $50.00 - Single Family Cases
    $100.00 - All Other Cases

  6. No case will be processed unless all of the above items are presented to this office three (3) weeks prior to a meeting of the Board of Zoning Adjustments.

  7. Petitioner will be notified as to the date, time and place of the meeting and should be present.

The Board of Zoning Adjustments meets once a month on the first Wednesday of every month in the Council Chambers of Kenner City Hall, 1801 Williams Boulevard, at seven o'clock (7:00) p.m.

** Zoning Adjustment cases regarding signs, add the following information on the building permit and drawing:

  1. Measurement of property (example, 130 X 150).

  2. Street frontage and side street identification.

  3. Location of sign(s), size of sign(s), height and square footage.
